Installment loan Problems when you are unable to pay California
I had a loan with - -, that originated -/-/- for $35000.00. By -/-/- I was unable to continue to make payments on the balance of $7700.00, as I was in danger of losing my home and had to use any available cash to make my mortgage payments. According to all three of my credit reports this debt was charged off -/-/-. -/-/- I received a notice from the SBA, dated -/-/-, that I had a debt due to them for $5800.00. On - -, - I asked for records in regards to this debt, which were sent and received -/-/-. I researched my records and SBA records. When I called the SBA, on -/-/-, to discuss the amount that was truly owed, I was told that the debt was forwarded to the Department of Treasury for collection.
During the time I have been trying to resolve the issue of whether or not or I had been given due process by the SBA, the Department of Treasury has intercepted $2100.00 of money due to me from the Department of Health and Human Services. They have also sent this debt to a collection agency and added fees and interest of $1600.00 and $62.00 respectively. I do not dispute that I may indeed owe the SBA some money. The contract with the SBA, -/-/- was to guarantee 50 % of the loan with - -. The amount that is truly owed has not been made clear to me. Why did it take five years for the SBA to contact me? I communicated with them about this debt within the 60 day time frame on the notice yet, now I have been sent to collections as if I have paid no attention to the original notice from the SBA dated -/-/-. I have documentation for all I have stated in this letter. Please help, - -
