Capital One Credit card department,
Summary : Had a credit card, was paying debt. Became unemployed and unable to pay ( -/-/- ), account went to collections. In - -, got a temporary part-time job and made arrangements with the creditor - - to pay $ -/month. Started -/-/-. -/-/- ( I 'm told ), the account was charged-off. I have been making $ - monthly payments to creditor since then. - -, I wrote to them to tell them to " STOP CALLING ME. '' I said nothing about them not doing anything else. -/-/-, they replied they " received [ my ] your request to close the above referenced account. '' WHAT??? And then later in the letter : " If you would like to may payment arrangements to resolve this issue, please contact us at -. '' Huh??? I already made payment arrangements with them when it was discussed and I agreed to do $ -/month - all I could do ; and notified them in the letter that I 'd let them know if/when my situation changed.
-/-/- ; do they then have any right to refuse current payments I make, in an attempt to say I was not " paying as agreed, '' or to make it seem as if I have not been paying? What is my right as a consumer? What is their right as a creditor? I have another letter to write to them, accompanying the next payment I 'll be sending, to let them know they did not follow my letter, or misinterpreted it, and further - they did not acknowledge receipt/crediting the payment ( per letter as they have done for over a year - prior to my letter of request ). What else do you suggest I do at this point? Please advise, thanks.
