RE : Bank of America Credit Card Account # - 1. On - -, 2016, I received an adverse action from - Bank after applying for a credit card. The reason, in part, was that I had - delinquent credit cards on my credit report. 2. In early - 2016, I found - accounts on my credit report, that should be removed per - - - - which states that accounts with adverse information can not remain on a credit report by more than five years. For background, all - accounts had collections issues in the past, but all - collections issues with each lender were resolved. Each account was closed and marked as paid as agreed. This all occurred over 5 years ago. 3. In early - 2016, I disputed all - of these accounts with -. ( confirmation # - - 4. By - 2016, - lender removed the adverse information, and a second lender deleted the account from my credit report. However, - lender, Bank of America, would not remove the
5. On - -, 2016, I contacted - to discuss the dispute with Bank of America. I was advised to contact Bank of America by -. 6. On - -, 2016, at - -, I spoke with - - at Bank of America Collections - I advised - of the situation and Bank of America 's violation of NYS law - - - refused to remove the credit card account from my credit report and instead demanded I pay Bank of America $39.00 for a closed checking account ( an account I had no recollection of, nor was reporting as a delinquent account on my credit report ). Rather than risk a new credit issue, I paid Bank of America $39.00 ( even though they provided no evidence that I indeed owed them for this newly discovered debt, nor could they provide details on the account 's history ). I warned - - of my intent to file a CFPB complaint over my experience ; he stated that a supervisor would contact me if they felt I had a valid claim. No one contacted me. 7. On - -, 2016, at - -, I spoke with - - at Bank of America Credit Reporting Department - I made her aware of the situation and my intent to file a CFPB complaint. I advised - of Bank of America 's blatant disregard for NYS law - - - advised that she would research my request, and 24 hours later, - called me back to state that Bank of America acknowledges my concern but it 's not their responsibility to address this issue. - faulted the credit reporting agencies ( i.e. -, and - ). 8. On - -, 2016, I started a new dispute with - over the same Bank of America account. I provided - with the updated information and my intent to file a CFPB dispute. ( confirmation # - ) 9. On - -, 2016, - responded to my second dispute and refused to take action. At -, I called - - and I spoke with " - '' a supervisor with - - She provided confirmation # - for the call. - advised me that - would not remove the account, and that I should contact Bank of America or dispute again. However, as I explained to -, I already dispute the account and Bank of America refused to remove it. 10. Due to the blatant disregard for NYS law - - by Bank of America, I am filing this complaint. While -, and potentially other credit reporting agencies may also be responsible for this violation, I 'm initiating my first complaint against Bank of America. I would also like to add, I feel extorted by Bank of America. After attempting to resolve an illegal credit reporting action, they forced me to pay them $39.00 for a checking account I had no recollection of. Moreover, they never resolved my original issue ( the removal of the credit card account ). I appreciate your help in this matter. Thank you.
