We own a - ( - ) and were offered " Merchant Financing '' by American Express. I spoke with them at length about the amount of the loan, how it was to be paid back and what payback was based on. The way the loan is repaid is within a year period, they pull a percentage of the credit card payments to the business before they hit our bank. My understanding after numerous conversations and seeing the numbers in the contract, was that the repayment was based solely on our last year 's income. I figured this was a good, smart way to structure a loan since we are a fairly new and growing -. I knew I could pay a percentage of our income based on last year. However, -/-/- I noticed something was wrong. We made $ - more -/-/- than last -/-/-, but somehow we still did not reach the payment amount American Express had set for the month. I called them and asked how this was possible if it was based on last year 's income. It took me numerous calls and follow up e-mails to finally learn that they had added a - % growth rate into the equation when they calculated our loan. I spoke to several people and, based on the fact that I was misled, asked them if they could extend payback to two years ( from one ) or give me a couple months break while I found a bank to refinance it. I was told no on both counts.
