I had a BMW 640i on a 36 month lease term with BMW Financial Services as the first payment on -/-/- following by 35 payments due on the - day of each month. On -/-/-, I traded in the car and leased a new car from the - BMW - ( a BMW dealer ). The BMW dealer told me that they will take care of all the paper work with the BMW Financial Services and pay off the remaining balance for the car. A few days later, I notice that another $860.00 monthly lease payment was deducted from my bank account on the car I already traded in. I discussed with the BMW dealer and was informed that either the BMW dealer or the BMW Financial Services will refund me the payment in
After - months, this has n't been resolved. I wrote a letter to the BMW Financial Services to state the situation of the transaction and I should not pay for -/-/- since I did n't own or have no possession or usage. The BMW Financial Services informed me that the $860.00 monthly payment was withdrawn through electronic auto pay on -/-/-, and dealer payoff statement already included this payment. They indicated that there was no refund since there was no overage in the account which was already paid off and closed. They told me to discuss with the dealer as this was between me and the dealership. It is now - -, after numerous email and phone communications with the BMW dealer and the BMW Financial Services, both of them denied to refund my payment. It is very clear that the BMW Financial Services withdrew the $860.00 monthly payment on -/-/- while I traded in the car on the same day and the BMW dealer was the new owner from -/-/- and after. Since I have informed the BMW Financial Services these facts, the BMW Financial Services should correct the payoff to reflect the proper ownership of the car and refund me the payment.
