In - my husband got a probate cash advance from a " probate inheritance advance '' company called ACAC , Inc . They had him sign a deed of trust and recorded said deed of trust against the real property in his mother 's estate even thought they told him that they would not do that until the loan became due which was -, -. In - - they filed a petition to have him removed as administrator and to force the sale of the family home. Since that time we have been fighting them in the probate court. In - of last year they filed a declaration showing that at the time of the transaction they did not have a Mortgage/lenders. We have filed a lawsuit against them. They are stating that it was an " advance '' and not a loan so California statutes do not apply. I am trying to find out what the difference is between a loan and an " advance ''. Any help would be greatly appreciated.
