Conventional fixed mortgage Loan modification, collection, foreclosure California
I was sold a predatory sub-prime loan in -/-/- by - Loans. I had a 80 % - mortgage and a 20 % - and I put nothing down on the home. After a year I got into trouble with the loans and I was facing foreclosure. With my parents help I was able to stave of foreclosure and I kept making payments on both loans for several more years. Finally I had to file a personal bankruptcy. Both my - and - loans were discharged in my Chapter - bankruptcy in -/-/-. I kept making the payments on the - mortgage to - - - and I am still current. However the second loan was sold by - to - Loans in -/-/-, and shortly thereafter - assigned the servicing of the loan to Real Time Resolutions. Now I have been attempting to obtain a refinance on the first loan but the lender and the title company can not clear title because the second deed of trust is still recorded in the name of -, which was a subsidiary of -. but is no longer in business. I engaged a lawyer to submit a Qualified Written Request to Real Time Resolutions who claims to have legal ownership of the second deed of trust. I asked RTR to provide evidence that they own the second deed of trust but they failed to provide that evidence in response to our QWR.
