- - - taken in - was added to parents bankruptcy - yrs ago. Late husband, me and my parents bought home together so Bankruptcy allowed - on their bankruptcy case. Some paymts cashed, others returned. 3 mos. prior to bankruptcy ending, sold loan to - - -, serviced by Green Tree Servicing. Green Tree merged with DiTech recently. Late husband has been dead for almost 12 yrs., but DiTech and Green Tree have been sending letters to my - address to my late husband. When I contacted Green Tree, it initially seemed it would go smoothly, except there 's over $ 2k with Bankruptcy that should have been posted to our loan more than a year ago and no one will file a claim for the money, they refused to give my atty an accurate acctg, and wo n't give me an accurate balance or establish payments. Atty has quit case Also, I remarried and moved to - in 2006. - transferred loan to a - office and changed the acct no. on the loan. Now that loan has been sold, Green Tree and DiTech have been listing my current husband 's home as the lien property, which it
year has passed. We have n't made a payment because we were advised by either the bankruptcy court or the trustee to keep payments until they correct the lien address, which they refuse to do. I believe they are trying to put us in a position that allows them to foreclose on the property. A rep. for Green Tree told me, in a recorded call, that foreclosure would not happen, but would not tell me what the payments would be. Instead, she told me to offer her a payment amount, and then suggested $500.00 a mo, which is higher than the original payment. At that time, I would n't agree to any amount because they did n't have the correct balance. When our atty at the time requested an accounting of the payments, including a correct balance after the $ 2k-plus has been posted, they returned the $ 2k-plus to Bankruptcy, stating they did n't know what acct the money was to be applied. Since I have specifically spoken to several representatives from Green Tree, they were completely aware of which account the money should have been applied. Green Tree, and now DiTech, has done nothing but give us the runaround. My parents still live in the - property but are old and sick. We want to sell that property and move them to - with me, but can not do that until we are able to straighten out the account with DiTech. Since they refuse to correct the lien address, I 'm at a loss, so I have decided that filing this complaint may help, especially since the recent letters which have been addressed to my now 12-yrs-passed late husband, were sent concerning submitting a complaint about their handling of our account. These letters were sent, according to a DiTech rep, due to recent litigation.
