THIS IS NOT A DUPLICATE COMPLAINT. In -/-/-, my grandfather was -/-/- years old, a -, a veteran that was -, when Urban Financial of America , LLC ( Urban Financial '' ) sent a Truth In Lending Act ( TILA '' ) letter stating that it was the master servicer and creditor for my grandfather 's reverse mortgage ( the Reverse Mortgage '' ). Urban Financial, hid and misrepresented facts about the Reverse Mortgage while my grandfather was alive. My grandfather died in -/-/-. Currently, Urban Financial is trying to foreclose on the home that I inherited from my grandparents ( the
of my grandfather 's estate, and foreclose on the Property to add the Property to its wholesale lending properties. Urban Financial will share the profits from foreclosing the Property with other entities, - - - -, in -, - ( - '' ) the reverse mortgage originator, - ( - '' ) in -, - the Reverse Mortgage servicer, and - - - - in Washington and California ( Quality Loan '' - foreclosure trustee company that initiated foreclosure on the Property in -, -, and -. In -/-/-, my grandfather 's mortgage was a conventional mortgage ( the - Loan '' ) with - - - ( - '' ) before the Reverse Mortgage. In -/-/-, - transferred servicing of the - Loan to a new servicer. Within a few months after the transfer, the new servicer refused to accept, process or give requested information about making payments for the - Loan. On or around -/-/-, - -, initiated foreclosure on the Property. At that time, - - performed a bait-and switch sales tactic to keep my grandfather in the Reverse Mortgage, to foreclosure on the Property. Before my grandfather died - promised me that my grandfather would receive a Veteran 's guaranteed loan ( the VA Loan '' ) after the Reverse Mortgage was taken out to prevent foreclosure. However, - - refused to honor the promise of the VA Loan. After my grandfather died, I discovered documents for the Property that were not properly executed and recorded according to state and federal laws. I am informed and believe, - - and Urban Financial planned foreclosure, during the signing of the Reverse Mortgage in -/-/- and after my grandfather 's death. In -/-/-, - - claims that the Reverse Mortgage was sold to - - in -/-/-. However, there are no records of this transfer. Instead title records have Urban Financials Assignment with an instrument number dated for -/-/- for the date -/-/-. The Assignment, does not have, under penalty and perjury as required by California and Federal law. The TILA letter is addressed to the wrong address. Urban Financials Allonge for proof ownership of the loan, is addressed to the wrong address. The Substitution of Trustee is incomplete and does not state the entity that requested the recording of the document. Urban Financial blames all errors on -, as if it does not know about the errors, when it is the master servicer. All of Urban Financial 's records for beneficial interest are inaccurate, incomplete, unverified, forged, fraudulent, misleading, and it misrepresented the time frame to either payoff the mortgage or sell the Property. I did not get a fair opportunity to advertise the property if I wanted to sell and options under RESPA laws to shop for the best interest rate to refinance into. Urban Financial conduct is unfair, deceptive, misleading, and fraudulent.
