PNC Mortgage is not allowing a short sale to proceed because the - buyer cancelled the purchase. A few days later a - buyer submitted a complete package to PNC Mortgage, but PNC refused to delay the trustee 's sale to allow the 15-days needed to approve the new deal. This is a violation of Cal. Civ. Code section 2924.11 ( d ) because once the buyer and seller was approved for a short sale and proof of funds supplied PNC was required to file a notice of rescission of the trustee 's sale resulting in dual tracking.
