After discharge of a chapter - bankruptcy, where the - lien was stripped by the court, due to the declined value of the property, the - lien holder filed a motion ( subsequently granted by the judge ) to re-open the bankruptcy as they felt they had not been notified of the intent to strip the lien. This in all likelihood was due to the - lienholder failing to record the lien timely. However, i was not notified by the - lienholder attorney that a motion was filed. The mortgage company never notified me of any issues, the mortgage company 's counsel never served me, I found out about the motion through the title company while trying to close the sale of my house. The sale has now fallen through due to issues with a clear title, so now i have not only lost the sale, but am also responsible for the buyers appraisal and inspection fees.
