This investigation request is in reference to the borrower applying for a HAMP Tier - loan modification and being denied. As - - ' attorney, I filed an appeal to a denial of a modification application for a HAMP Tier -. Instead the servicer granted - - a HAMP Tier - loan modification which creates a monthly mortgage payment that is more than 31 % of her gross monthly income. This modification agreement at this time is not affordable for the borrower. Also, the servicer determined that the borrower should receive a HAMP Tier -, according to their underwriters, because granting a HAMP Tier - would change the terms of the mortgage agreement. '' When I requested information from the servicer in writing to determine which HAMP guidelines govern this decision, I did not receive a response in writing. Please help inform me which HAMP guidelines determine that a borrower ca n't receive a HAMP Tier - because it would change the terms of the mortgage loan agreement.
