Other (phone, health club, etc.) False statements or representation Attempted to collect wrong amount Colorado
I received an intent to sue notification in the mail on a debt to an apartment complex from a company called Wakefield and Associates. I knew this debt was owed and attempted to pay it immediately upon moving out of the apartment complex. I was told repeatedly that they did not have a balance for me so I quit perusing it until I received this summons from Wakefield. I immediately called them to try to settle out of court and set up monthly payments. Apx 1 1/2 years later I called to try and settle the remainder of the balance and was informed that they had been applying my payments toward a separate debt that was more than 10 years old. I was then told that my balance on the original debt to the apartment complex had been inflated to over $- from the original balance of just over $1300.00 due to attorney 's fees and interest. I was unaware of the medical debt until 2 days ago when I learned they had been paying on that - instead. I do n't know the debt laws very well but it seems that by attempting to pay the debt down, I should n't be sued. It also seems that the money I give a company for a specific debt should be used for that debt and not for whatever they feel like applying it towards.
