On -/-/- a debt collector called - - - ( " - '' ) unlawfully obtained a copy of my Experian credit report. The creditor did not have a " permissible purpose '' as defined in The Fair and Accurate Credit Transactions Act of - ( " FACTA '' ). I have repeatedly reported this to Experian to no avail. Experian says it ' can not remove an inquiry ' which evidences a fundamental indifference to the complaint I am making. I have stated to Experian in no uncertain terms that it is not that I am trying to remove an inquiry from my report, but to prevent the infomation in my report from being released to one of Experian 's customers that has no legal permissible purpose to obtain the information. FACTA makes clear that " debt collection is a permissible purpose for obtaining a credit report under - only in connection with a 'credit transaction ' in which a consumer has participated directly and voluntarily. '' - ( - ), -.

Likewise, in - Experian Information Solutions , Inc., - - - ( -., - -, - ) the - Circuit Court of Appeals held, just a few months ago, that a creditor may only lawfully obtain a credit report only if the underlying debt was in the nature of a credit transaction. Despite this, Experian is not vetting its customers to ensure this is not happening. Threre is no judgment, or contract, or credit transaction in this case. In fact, anyone can simply claim anyone owes them a debt but that does not then make it legal for Experian to divulge information in a credit report in violation of FACTA. An example of this extreme negligence on the part of Experian will now come in response to this very Consumer Financial Protection Bureau ( " CFPB '' ) complaint. Experian will conduct no meaningful investigation and almost certainly respond to the CFPB with a stock answer that does not address this complaint. Further, I expect Experian will do nothing at all to curtail the abuses of - in unlawfully obtaining credit reports and using the information from those reports to harass the public. Experian 's indifference in this regard is a clear violation of the Fair Credit Reporting Act and Califonrnia 's parallel Consumer Credit Reporting Agencies Act.
