Upstate Collection Center, Inc. Debt collection department,
False statements or representation Attempted to collect wrong amount New York
In early 2016 I contacted Upstate Collection Center for an amount due on an account I had with the bank. The bank told me they sold the account to them. I spoke to a lady named - - who was in charge of the account. I informed her that I wanted to settle the account and if they would take $1500.00 to settle. She told me call me tomorrow and I will see if the bank will take that amount, which I found weird because the bank told me that they sold the account to them. When I called her the next day she said we can settle for - that is what the bank is asking for. I told her ok let me see if I can get the rest. The car in question got into an accident and was total. I went to the bank reported the incident and they advised me to call upstate collection center pay the amount we agreed upon to get the lien off the car. I called - - and asked her if the settlement amount was still the same -, she responded yes so I told her that a gentleman named -
the car was total. I said your just the collection agency collecting a debt, not the bank, the bank is the lien holder not them. I asked to speak to - - and she refused. I told her that we made a settlement agreement and the insurance company was going to pay them and she stated well since they are paying this is the way it is we are charging them the full amount. I told her 4 days ago I was paying and it was -, her response was too bad that 's how it is like it or not. If you want the lien off you have to pay the full amount. This whole conversation taking place while - was on the phone, they were shocked, I was shocked and beside myself. - decided to put the account on hold until they come to terms with the agreement.
