Background : I had a cheque for $4100.00 issued to me, my wife and a 3rd party ( a medical provider ). I deposited the cheque -/-/2015 without any endorsements into our joint account ( wife and I ) at Chase. At the time I just didnt notice the 3rd party name on the cheque. I usually never endorse cheques anyways even when the clerk asks me to. My response is always to put whatever hold they need to on the funds. Clerk at Chase processed the cheque. Seemingly the issuing bank, - -, also processed the cheque and all was good until yesterday. Yesterday : Chase called me saying that they have received a claim against the cheque. They refused to provide any copy of the claim nor clearly state who issued the claim : - -, the Payer Party of the cheque or the 3rd Payee Party. They keep saying it is


the first place. I suspect the Payor party is holding - responsible for allegedly processing an allegedly improperly endorsed cheque and have asked - to recover the funds. - wanting to retain the business of their customer has after 1.5 years gone bank to Chase ( my bank ) to ask for the funds back. Chase has contacted me and informed me that they will return a third of the funds back to -. I have asked them where did they come up with the figure of a -. Their only explanation is since there were three parties on the cheque each one is entitled to a third. I have told them that if the claim that the cheque was improperly endorsed is valid and can be honored 1.5 years later then I would agree to them returning all the funds. I have warned that if they proceed and return only a third that would be illegal as it is not their place to decide who gets what nor are they in any position to know exactly how much of the funds the third party is entitled to or that he is even entitled to any of it. They are wanting to play judge and arbitrator. Questions : # 1 I need to know what the banking rules say regarding returning cheques. Can I cheque that has been cleared for a year and a half suddenly get returned? Is there a limit? They cant possibly be allowed to go back 10 years, so what do the rules say in that regard? # 2 if they are allowed to go back, do the rules allow a bank to request a return based on an issue ( in this case missing endorsement ) which they had ample time to process and catch the error a long time ago and did not, or decided not to, or for whatever reason they did not decide to act until a year and half has passed. # 3 Can a bank ( in this case my bank Chase ) process the return request ( assuming - is indeed allowed to request returns even after a year and half ) by sending back only a fraction of the funds? Conclusion : I need to know the rules and my rights in this situation. Once I know them, I will contact you for assistance as what should happen next. Sincerely - -
