I have a vehicle loan with GM Financial for my - KIA Soul. -/-/- I had to file a - - bankruptcy in an attempt to save my home from foreclosure. My loan with GM Financial has never been late or was never in default. I had to put the loan in with the - - restructuring plan per the bankruptcy trustee 's orders in spite of it being in good standing. I made every single plan payment in my chapter - case but I had to have my case dismissed in - - and surrender my home due to my mortgage holder constantly contesting my proposed payment plan thus making my home unaffordable. During the time the car loan was under the protection of the bankruptcy trustee GM Financial reported payments as late to the credit bureau which is illegal. The Chapter - case was dismissed without prejudice in - -. Once the case was dismissed I immediately resumed without delay paying my auto loan outside of the bankruptcy plan. I have been out of the Chapter - plan since -/-/- and I have made every single car payment on time but GM Financial is not reporting my payments


paid on time and is no longer part of the chapter - wage earner plan. GM financial is still reporting the loan to the credit bureau as part of the chapter - bankruptcy plan and I am not getting positive marks on my credit bureau reports for making 6 on time payments. During this time period after the bankruptcy case was dismissed GM Financial has continued to collect the interest of 14 % every single month I have sent in my payments but GM Financial has not honored their responsibility as a lender to report my positive payment history to the credit bureaus. Whether or not this was an oversight on the part of GM Financial it is still illegal and has caused damages to me. My financial situation has slowly been improving since receiving a fresh start under the bankruptcy code as well as finding more affordable housing. I would like to refinance out of the high interest rate car loan in order to get my car paid off faster but I am unable to do so because they are not reporting my payment history. I feel they are doing this on purpose to trap me in a high interest rate loan for their own monetary gain and nothing more. I would like my payment history reported to the credit bureau correctly, the interest refunded on my loan from from -/-/- until -/-/- due to their mistake, or the chance of obtaining a possible loan modification with a reduced interest rate due to outstanding payment history for 20 consecutive months.
