NC Financial Solutions of Utah, LLC d/b/a NetCredit ( hereafter " NetCredit '' ) is loaning money to consumers in - and charging an annual interest rate of 150 percent. -. Code Ann sec 6.2-1501 ( A ) requires consumer finance companies charging a rate of interest in excess of 12 percent to first obtain a license from the - State Corporation Commission . NetCredit is not licensed as a consumer finance company by the - SCC. When questioned about the above, NetCredit claims that their - license authorizes it to make loans to - residents. ( 1 ) Utah does not even license this kind of business. Businesses are merely required to give notice if they are conducting this kind of business in -. ( 2 ) NetCredit is a -, LLC with its offices in - and, as near as I can tell, no physical locations in Utah ; and ( 3 ) - absolutely has the right to statutorily regulate loans made to its residents. - Code Ann Sec . 6.2-1541 provides that loans made in violation off sec. 6.2-1501 are void and NetCredit is obligated to return all principal, interest and fees paid by me.
