I currently have student loans serviced by Navient. I am also a co-signer on my brother 's student loans. When I login to my account to pay my loans, my brother 's loans are presented as part of my total student loan payment. My cosigner agreement states that I am a guarantee for my brother 's loans, not primarily liable. However, the Navient website is deceptive, and makes it appear as though I am primarily liable for my brother 's loans, even though he is making payments on them. I want my brother 's loans removed from my account summary page, and for Navient to stop deceiving me into thinking that I am primarily responsible for this debt. I believe that this practice is a violation of my state 's Consumer Protection Act as well as the Fair Debt Collection Practices Act ( FDCPA ). I called Navient and was lied to by the representative, who told me that I am equally responsible for making these payments even though my brother is current on his payments. I was told that this could not be removed from my account. These deceptive practices need to stop. I will consider any and all legal action, including a class action lawsuit if this is not resolved.
