Received a letter from a lawyer offering to represent since - - was being sued. After researching with the clerk of the court discovered that - -, on behalf of Citfinancial - was suing. Citifinancial has illegally re-aged the date of first delinquency through deceptive practices. They NEVER sent an invoice for years yet they were drafting from - - 's bank account $50.00 each month. After numerous demands for statements - all thise will be attached - Citifinancial gave a run around include saying the account did not exist. When statement copies were finally received it was discovered that the $50.00 a month did not even cover the interest each month, so this would have been paid on forever. Also Citifinancial was reporting this to the credit bureaus as charged off and not reflecting that any payments were being made on it at all. After careful research it is clear that numerous Federal laws were broken ( see attached letter sent to -, The - Court, and the attorney - ). Payment was immediately stopped to them. Texas - - - stipulates the statute of limitations. This is outside of the statute as they illegally re-aged every time they took a payment. The date should be the date of first delinquency with Citifinancial. Not the date they kept taking the $50.00. Additionally by not providing a periodic statement The Credot CARD Act of 2009, Fair Credit Billing Act, and Fair and Accurate Credit Transactions Act are all in violation. Due to inaccurate reporting to the credit bureaus, The Fair Credit Reporting Act is in blatant violation.
