I recently attempted to obtain a mortgage, at which time I discovered that Commonwealth Financial Systems had a judgment against me for $4000.00 ( for a - - credit card from -/-/- ). I was never notified that there was a lawsuit pending against me. I went to the - Court system website and printed out the entire case file. It was then that I noticed that they documented at least 5 unsuccessful attempts to serve me with the paperwork. The final attempt, which they say was successful, is dated -/-/-. I did not move to my current address until -/-/-. It is at this address that they claimed they served me. Which is patently false. The file says the case was dismissed once for failure to notify me, and I feel that legally they can not uphold a judgment that was obtained without my knowledge. I need some guidance to see if I can have the judgment overturned based on the affidavit of service that indicates that I received the subpoena a full 9 months before I even moved to my current address. If I am able to have it overturned, they will not be able to sue me again, since the 4-year statute of limitations has long since passed on this debt. I am attaching the full copy of the case file. I also have a copy of my current apartment lease that can be furnished if needed. Please advise what my next step should be in this issue.
