FCRA 623 ( a ) ( b ) requires debt collector ( North American Recovery ) to accurately report the DOFD ( - ) separately to the CRA ( - ) no later than 90 days after commencing collection efforts. - - - provided North American Recovery with the DOFD per FCRA 623 ( a ) ( 5 ) mandate. FCRA 605 ( c ) was created for - purpose only, to affix a date on the commencement of the delinquency which proceeded the collection, thereby specifically preventing collection agencies from illegally changing and extending the DOFD once the original creditor establishes that date. An accurate DOFD can NEVER be legally changed, especially by a Collection Agency.
American Recovery failed to timely produce ALL documents requested. A 30-day Notice was submitted on -/-/2016 by Certified Mail Receipt. I contacted a representative with North American Recovery and informed them that I was trying to buy a home and inquired whether they would be interested in a " Pay For Delete Settlement '' and was told no. I asked the representative to verify DOFD and was informed that their records indicate their collection began - and would continue reporting to the credit bureau until -. On -/-/2016 I sent a dispute letter to North American Recovery disputing their implied DOFD and requested verification and to produce documents and all instruments bearing my signature. I also contacted a Manager at - reporting agency. - assured me that although North American Recovery began their reporting on - the DOFD was already established by the original creditor and remains at - and is scheduled for removal on -. On -/-/2016 I called North American Recovery and spoke with - to ask if they would reconsider the " Pay For Delete Settlement '' because I was still trying to purchase a home and my account is scheduled for removal on -. - stated no they would not accept my offer and North American Recovery had extended the DOFD to -. After reviewing my credit report it turns out that North American Recovery has indeed illegally extended the DOFD by two months. On -/-/2016 - began reporting DOFD as -. FCRA 623 ( a ) ( 5 ), FCRA 605 ( c ) and TE-AS FINANCE CODE. -. ( - ) was specifically created to protect consumers from illegal and abusive tactics, unfair and unconscionable means by Collection Agencies and Original Creditors. North American Recovery should be held accountable for violating FCRA and TE-AS FINANCE CODES compliance standards that governs collection activities. Attached is a copy of the Account History provided by North American Recovery, a copy of - reports, and a Certified Mail Receipt copy of my dispute to North American Recovery. I will be seeking immediate deletion of this negative trade as well as a settlement in damages for their illegal practices.
