- -, 2016 To whom this may concern : I recently pulled my credit after several years of not using my credit, and was shocked to see my report had a few accounts that were still open. - of the accounts was 800loan Mart. I was under the impression that the car that was repossessed from me paid the debt back through the auction of the vehicle. I contacted the company in question and spoke to a representative - - - - that was able to explain to me what my old vehicle was sold for that I still had a balance. This arrangement was made in on - -, 2016. I was sent a letter and was told that my - - account would be charged $100.00 per month until the balance of $1200.00 was paid off. A few weeks went by and as my bank statements came in I noticed that my account and payment was n't drafted out of my account on - -, 2016 as we had initially agreed. I placed a call back to the company and was routed to - -. On
this debt. He explained to me that the total cost was $1300.00 ( a copy of each settlement letter has been uploaded ) and he was going to send me a settlement letter and that I needed to sign it and send it back to him in which I did. I explained that I was able to make a payment on this account on - for $100.00. He also explained that the monthly fee was to be on - - and on the first of every month thereafter. He contacted me on Thursday and advised me that the payment did n't go through because my debt card came back NSF. I had an issue with my bank and the payment could n't be processed until Friday -. I called back on Friday - to try and make a payment in which I was n't able to contact - - ( attached phone record ). Today - I placed a call to - - and he advised me that the agreement was VOIDED out due to payment issues and that it would n't be reconsidered if I did n't give out my work information. I asked him as to why he needed such information and that the purpose of my call today was to make the payment ( $100.00 ) - acted in a harassing manner as to which he terminated the call with the fact that the original amount of $6800.00 would need to be paid off in order to eliminate this from my credit. I asked him politely to level with me, and to resolve the issue which was the total payment on the account and not take this in a personal manner. He seem more interested in knowing my personal business like why I wanted to pay this debt, not to resolve the issue in hand. Again, I asked to keep my personal business out of this and he completely ignored the request and proceeded to ask where I worked at. He insisted on knowing my place of employment and asked repeatedly on my employment status. He advised me that the company would take me to small claims and threaten to sue me regarding the remaining balance. Again, I asked for him to not take this in a personal manner and asked if I could make a payment today. He told me the contract would be voided out and the amount that is owed is $6800.00. He acted in a unprofessional way and manner that he hung up on me after I told him that the manner in which he acted I was going to file a complaint with the FTC for violation of the FDCPA act ... This was the last time I spoke to anyone regarding my account at 800 Loan Mart ... The Fair Debt Collection Practices Act ( FDCPA ) protects debtors from harassment by debt collectors. If a collector has violated the FDCPA, you can sue the collector in court. The FDCPA provides a range of damages for successful FDCPA lawsuits, k including monetary damages, attorneys fees, and more.
