I applied for a debt consolidation loan with the Lending Club on - -, 2016. I was called by a representative of the Lending Club on Saturday - - to confirm my application and personal information. The representative told me the loan terms were : $16000.00 at an APR of - %, $330.00 per month for 60 months. My loan was approved on - - ( Loan # - ) and the funds of the loan were direct deposited into my checking account on - -. However, only $15000.00 was deposited. I immediately emailed the - - and asked why only $15000.00 was deposited in my account. The loan documentation was not available until the loan was funded and there is nothing in the documentation that indicates the origination fee that would be charged. On - - I spoke with a representative of the Lending Club to claim a lack of notification about an origination fee. At no time did I receive notice by phone or in writing regarding the amount ( if any ) origination fee that would be assessed prior to the funding of the loan. I specifically asked the representative that called me on - - about the terms of the loan. There was no mention of an origination fee. Even after complaining about the fee on - -, I was not told of a right to rescind the loan and return the money ( I was within the 3 day window ). I believe the Lending Club violated the " Truth of Lending Act '' ( TLA ) by not providing adequate notice of all fees before the loan was " funded ''. Not having all of the information ( even after I requested it ) before the loan was funded is a clear violation of the TLA. This loan was fraudulently funded.
