I have had the unfortunate experience of having an account that was previously deleted from my credit file re-inserted in direct violation of the Fair Credit Reporting Act. 611 ( a ) ( 5 ) ( b ) ( i ) ( A ) the information may not be reinserted in the file by the consumer reporting agency unless the person who furnishes the information certifies that the information is complete and accurate ''. The account was originally deleted with -, but when the responsibility of collecting the alleged debt was transferred to AMSHER COLLECTION AGENCIES, it was reinserted to my credit file without certifying that the information is complete and accurate.
a phone call to AMSHER - -, 2015. After much time and many transfers, I finally was speaking to the proper customer service representative, -. I explained the mistake, it was likely an administrative error, requested AMSHER immediately delete the account and inform the credit reporting agencies. She stated, Since we do not purchase debts, we can not remove them from the credit reports. I informed her that this is in direct violation of the FCRA since they are furnishing the information! If they can furnish derogatory information then not only can they delete it, but it is their responsibility to delete it, especially when made aware of the violation of the FCRA ( re-insertion of previously deleted information ). She transferred me to her manager, - -. I again explained the situation to -, but he stated that since they recently acquired the debt that it must be valid and therefore can not be deleted ( he stated nothing about not being able to delete it since AMSHER does not purchase debts '' ). I informed him that these are significant violations of the FCRA - both reporting inaccurate information and reinserting information that has not been certified to be complete and accurate - and even offered a solution whereby they remove the account in question while AMSHER and - internally resolve the issue. IF they certify the information to be complete and accurate, '' then they could re-insert it and be in compliance with the FCRA. How can any furnisher of information reject such a common sense solution that is in compliance with the FCRA? I informed him that I am extremely familiar with the FCRA, and I will immediately file a complaint with the Consumer Protection Financial Bureau if he is not willing to delete it as this is an extremely clear case. He told me to do what I have to do. I request the account be immediately and permanently deleted from my credit file as these violations of the FCRA are negatively affecting my ability to gain employment. Due to my employment application situation and the clear violations of the FCRA, I ask that my request for deletion be expedited. Thank you for your consideration.
