I took out a private student loan with my father as a co-signer through - - - ( - ) while attending - University -. After I withdrew from school, I used used up all the deferrment and forbearance options while trying to work and pay off loans and living expenses. At the moment, I am 147 days behind on my monthly loan payments through -. I have spoken with them and they are attempting to work with me to keep my loans out of default. However, both me and my father are also being continually contacted by agents from Simms and Associates, a collection agency out of -, who says that they are servicing this same debt and seeking payment. They keep telling us that we must make some sort of immediate payment to them to keep the loan from defaulting, going outside their office '' and causing them to seek a judgement against both my father and myself that would include garnishing my wages and taxes as well as garnishing both my father 's social security payments and his pension. I have repeatedly told the agents from Simms and Associates that


not - directly in order to avoid garnishments. What I would like to do is keep working with the service providers at - to keep my loans out of default, but I am unsure if I should take the threats from Simms and Associates seriously and, if so, if I should be making payments to Simms and Associates or keep making payments to -. Furthermore, I would like to make myself as the primary person responsible for this debt the contact person for all calls, letters and other communication and stop them from harassing and threatening my - father about garnishments on his social security and state pension. I hope there is some way to find a solution to this problem that will work for everyone involved? I am more than willing to make payments on these loans, but I need them to be payments that work within my budget and place responsibility entirely on me and stop the harassment and threats to my father.
