FOR HIS CONCLUSION : One West Bank FSB does not have standing to foreclose on the subject property as it is not the holder in due course of the subject loan. According to PSA which created the trust which currently owns the loan, the only possible holder in due course is - - - - - as trustee for the IndyMac - -. However, - and IndyMac Bank, FSB violated their own securitization trust documents. Therefore, - lost its interest in the subject property and its right to foreclose by violating its own PSA, giving both the homeowner and the REMIC investors a cause of action for fraud.
