I am a cosigner on an -. The load has gone into collections because none of the benefits of VSAC loans are attached to this loan. There are no reduced payments, no deferments and I am not allowed to consolidate this loan because it is a private loan. I filed for bankruptcy a few years back and the loans were not discharged even though they are private loans. The loans have gone into collections and I was told that I would be allowed to have a hearing based upon hardship. VSAC placed an offset on my tax return that I had intended to use to pay my Federal taxes. I was expecting to receive a property tax rebate that is based on my income and my ability to pay my property taxes. This money has been used to offset my VSAC loan. VSAC sent me a letter telling me they had confiscated my tax rebate and that I had a right to a hearing upon request. I sent a letter to them requesting a hearing and was denied. I rely on this money to pay my property taxes to my town. I have not been able to work out any arrangements with the collection agency. When I spoke to a representative from VSAC on the phone she told me to speak with the collection agency eventhough VSAC is sending me correspondence. I would like some help with working this out with VSAC. I would like a hardship hearing and I would like to know why private loans are not being discharged in bankruptcy. I still have bills that need to be payed before my loans.
