Like many Americans I have a large amount of student loan debt. Moreover, as hard as I have tried I have struggled to obtain employment that simply allows for a standard of living let alone enough pay student loan payments. The jobs are simply not available in my career field. In -/-/- I filed for chapter - bankruptcy. All of my private student loans went into default as a result and were charged off. In -/-/- my bankruptcy was discharged and in -/-/- I received phone calls and letters from Sunrise Credit Services. I advised them at the time I was just coming out of bankruptcy and had just started a new job and would mail in payments in an attempt to pay down my debt and hopefully settle. Starting in -/-/- Sunrise received their first payment and - subsequent payments for - and -. During the month of - and - I received letters and numerous phone calls. Each correspondence in my part, whether in writing or via phone, was typically responded to. On each occurrence I was advised that my payments were unacceptable and legal action would be sought. The only payment that would be accepted was for
other end would disconnect during our phone conversation and after not receiving the response they were looking for would hang up and immediately call back. On many instances I would receive a phone call, a voice mail message would be left, and then immediately call back again and leave another message ; sometimes calling - times within - minutes. Their phone calls often times originate from numerous sources ; sometimes an - number, sometimes a - prefix, many times a VOIP number registered in - or -. I notified Sunrise that I perceived this as harassment and to please cease the amount of calls. Contact with Sunrise greatly slowed down. However, they proceeded to contact my ex-wife, who under our divorce agreement, is not responsible for and is to be held harmless for my student loan debt. Sunrise has been advised of this. Nonetheless, phone calls to her place of employment continue. My ex-wife has stated that calls to her work take place as many as - times a day. Each phone call is perceived as threatening and demands immediate payment or she will be sued in an attempt to collect the full debt. I have made several attempts via phone and letters advising Sunrise Credit to contact me and only me. In -/-/- I notified Sunrise, as well as my - other student loan lenders, that I was laid off work on the last day of - and anticipated that no later than - I would be able to resume making payments. I also advised them that I would keep them up-to-date at least once a month as to my status. Once I attained regular employment I would be able to again resume payments. In -/-/- I attained employment and notified Sunrise, along with all of my other creditors, that I would be able to resume payments on -/-/-. On - - I received a letter from Sunrise Credit dated - -. It made the following statement : '' O.K., You have made it clear. You refuse to pay the money you rightfully owe - - -. Now, we would like to make something clear to you. - way of another, you may have to pay this debt '' - - - must now determine how to proceed. They can opt to file a lawsuit against you. This may result in you being required to appear as a defendant in a court of law. Your opportunity to resolve this matter are quickly running out. '' The statement I have refused to pay is fictitious. I have sent in copies of my payments.
