Synchrony Bank is now reporting to multiple consumer credit reporting agencies in violation of Section 607 ( b ) of the Fair Credit Reporting Act. I filed a - - action on - -, -/-/- in the - - of New York. I obtained a discharge on - -, -/-/-. At the time of filing I owed a debt to Synchrony Bank. I had not missed any payments prior to filing. Upon discharge, Synchrony updated my consumer credit agency records to show late payments in - -/-/- ( after my filing date ) and entered a charge off '' notation for each month from - -/-/- through - -/-/-. I disputed the notations as violations of both the automatic stay and the discharge order. Through - disputes the bank refused to correct the information. It came to my attention when I investigated a credit score drop. Also attached is an FTC Advisory Opinion stating in relevant part Section 607 ( b ) of the FCRA requires credit bureaus 'to follow reasonable procedures to assure maximum possible accuracy of the information concerning the individual about whom the report relates '. '' It goes on to state it is not a reasonable procedure to label an account that has been discharged in bankruptcy as 'charged off as bad debt ' if the account was open and not charged off when the consumer FILED bankruptcy. '' Do note that the FILING date is the relevant date and NOT the discharge date. Given this, no information should be reporting after - -/-/- regardless of the accounting treatment of the account.
